Membership Agreement

ARTICLE 1 — PARTIES

This Membership Agreement is concluded electronically upon the creation of the membership between Pegia Dış Ticaret A.Ş. (Kazlıçeşme Mah. Prof. Dr. Muammer Aksoy Cad. No: 4/C Zeytinburnu/Istanbul; Mersis: 0723092869000001) and the user who becomes a member of https://www.derimarket.net (the “Member”).

ARTICLE 2 — SUBJECT

The subject of this Agreement is to determine the conditions for the Member’s use of https://www.derimarket.net and the rights and obligations of the parties. Membership is free of charge.

ARTICLE 3 — MEMBERSHIP

To become a member, the individual must be at least 18 years old and complete the registration form with accurate and up-to-date information. The Member is responsible for the confidentiality of the account information and all transactions carried out through the account. If there is suspicion that the password is being used by third parties, the Seller must be notified immediately.

ARTICLE 4 — MEMBERSHIP BENEFITS

The Member may view their order history, initiate the free return process by creating an order-specific return code, view and use the balance of money vouchers assigned to their account for payment, and manage their addresses and preferences.

ARTICLE 5 — PERSONAL DATA AND COMMERCIAL ELECTRONIC MESSAGES

The Member’s personal data is processed within the scope of the KVKK Disclosure Text. Commercial electronic messages regarding campaigns and announcements are sent only with the Member’s separate and freely given consent; consents are managed through the IYS, and the Member may exercise their right to refuse at any time. Membership may not be made conditional on consent to commercial communications.

ARTICLE 6 — MEMBER’S OBLIGATIONS

The Member agrees to use the site in accordance with the law and the rules of good faith, not to conduct transactions using another person’s information, and not to engage in actions that may damage the site’s software or content. All content and trademarks on the site belong to Pegia Dış Ticaret A.Ş. or its licensors and may not be used without authorization.

ARTICLE 7 — TERMINATION

The Member may terminate their membership at any time by closing their account or writing to destek@derimarket.net. The Seller may suspend or terminate the membership due to a breach of this Agreement, unlawful use, or security reasons. Termination does not affect the Member’s rights and obligations accrued up to the termination date; records that must be retained under applicable legislation will continue to be retained.

ARTICLE 8 — AMENDMENTS

The Seller may amend this Agreement. Amendments are published on the site, notified to the Member by email, and enter into force 7 days after notification. Orders placed and rights acquired before the notification date are not affected by the amendments. A Member who does not accept the amendment may terminate their membership until the effective date.

ARTICLE 9 — DISPUTES

This Agreement is governed by Turkish law. In disputes arising from consumer transactions, Consumer Arbitration Committees have jurisdiction within the monetary limits announced by the Ministry of Trade; in cases exceeding those limits, Consumer Courts have jurisdiction and authority, provided that mediation is sought before filing a lawsuit pursuant to Article 73/A of Law No. 6502.
